RV & CAMPER RENTAL AGREEMENT

This Rental Agreement shall evidence the complete terms and conditions under which the parties whose signatures appear below have agreed. Stone Mountain RV & Camper Rentals shall be referred to as “SMRV” and the guests named below shall be referred to as “RENTER”.

When reserving a campsite or other location, RENTER agrees to providing a campsite that can accommodate up to a 34-ft trailer in length with room for adequate maneuverability with the truck and trailer connected.

1. RV SLEEPING CAPACITY. Each camper sleeps differently based on factors. RENTER certifies that RENTER agrees to and understands the limitations placed on the number of persons permitted to occupy the camper, and unless prior written approval has been granted by SMRV, RENTER agrees to abide by such limitations. Above RENTER is at least 25 years of age and will be an occupant of the camper during the entire reserved period.

2. PAYMENT POLICY: A security deposit for this reservation is determined at time of booking and is required at the time of booking to make the reservation. Rentals during any Holiday event will require 75% payment at time of booking. For non-holiday weeks and/or calendar events, the reservation will require 50% payment at the time of booking. Deposits can be made by direct deposit using several forms of money transfer options such as Zelle, direct deposit, paypal, venmo, etc. The balance of the reservation is due upon arrival of the reservation and can be made in the same ways listed above or with cash or check at time of arrival.

3. CANCELLATION POLICY: The deposit terms as listed in Section 2 above shall be:
a. At 10 days prior to check-in, the deposit shall be forfeited in whole, with no refunds.
b. At 20 days prior to check-in, 50% of the deposit shall be forfeited.
c. At 30+ days prior to check-in, 10% of the deposit shall be forfeited.
d. No refunds or any of the conditions listed above will be given for cancellation or interruption that occurs due to inclement weather. Additionally, no refunds will be given for cancellations of reservations during a holiday and or event week for early check-outs or no-shows unless in written notice by SMRV.

4. RENTAL INSURANCE: Rental insurance must always be active. If the RENTERS insurance company does not cover the camper, the RENTER agrees to pay for any of the repairs, fixes, or damages in full without negotiation and payable within three (3) business days upon receipt of the repair(s) order(s). The deposit will be used towards any of the damage and will not be returned to the RENTER for any reason.

5. DAMAGES AND CLAIMS: The Security Deposit as outlined in Section 3 is provided as security against damage to the camper, theft, late check-out, and violation of any RENTER’s agreement contained in this Agreement. An inspection is done after each check-out for any damage done to real or personal property. The RENTER(s) shall be liable and solely responsible for any property damage, accident, injury to any person or loss sustained by any person or arising out of or in any way related to RENTER(s) use of the camper or the items of personal property provided by SMRV hereby agrees to indemnify and hold SMRV harmless from any and all claims, including those of third parties, arising out of or in any way related to RENTER(s) use of the camper or items provided therein. RENTER(s) assumes the risk of injury or other losses relating to any recreational activities and will hold SMRV harmless with respect thereto RENTER(s) agrees to indemnify SMRV for any damages to the dwelling, grounds, furnishings, and household items. In the event that damage result from a RENTER(s) occupancy, SMRV is authorized to utilize the credit card on file or the cash security deposit to cover said damages or additional cleaning costs, including the charging or billing of any additional amounts that exceed the deposit held. SMRV is not responsible for articles left on the premises or in the camper. There will be a $25.00 charge in addition to shipping charges and handling ($50 per hour) the return of any articles found by housekeeping. Lost and found will be held for 10 Days. After such a time all items will be subject to donation to charity.

6. CLEANING: Each RV or Camper from SMRV will be inspected, sanitized, and cleaned after each departure. We ask that FAITH be returned with the following standards listed below. If a significant cleaning is required, appropriate charges will be deducted from the deposit at the rate of $50 per hour.

a. INSIDE CHECK-OUT:
i. Each bed has a mattress protector (white). These protectors can always remain on the bed(s) and will be replaced, removed, or cleaned as part of SMRV.
ii. All used linens will need to be stripped off each bed and placed on the floor of the bathroom.
iii. All used towels placed on the bathroom floor.
iv. All trash (inside and outside) is bagged and thrown away at your campsite and/or location.
v. After washing your dishes and utensils, if they still need more time to dry leave them out and we will put them away in the cabinets.
vi. Counters and common areas where food or your personal items were to be wiped down.

b. OUTSIDE CHECK-OUT:
i. The black and gray tank(s) will need to be emptied by RENTER unless otherwise contracted. If the RENTER would rather not empty, SMRV will empty for the RENTER at an additional $100 charge.
ii. IF PICKING UP: The hoses, electrical cords, surge protector, and sewage hoses shall be in proper working condition without defect and be placed back into the storage areas as shown prior to pick up.
iii. IF DELIVERY: The hoses, electrical cords, surge protectors and sewage hoses will be handled by SMRV.

7. NO SMOKING: Since some of the guests of SMRV have allergies and it is difficult to remove the odors and allergens associated with both pets and smoke, SMRV must STRICTLY ENFORCE this policy. If smoking inside the camper is found, SMRV reserves the right to charge $300.00 to treat the property for smells and/or allergens. In addition, any damage caused by smoking materials will be charged to RENTER’s damage deposit or credit card on file.

8. PETS: Unless agreed to in writing with SMRV directly, pets are not allowed inside the camper. Since some of the guests of SMRV have allergies and it is difficult to remove the odors and allergens associated with pets, SMRV must STRICTLY ENFORCE this policy. If evidence of pets is found inside the camper, SMRV reserves the right to charge $300.00 to treat the property for fleas and/or allergens. In addition, any damage caused by pets or materials will be charged to RENTER’s damage deposit or credit card on file.

9. PROVIDED SUPPLIES: Included in the reservation, SMRV supplies RENTER with an array of supplies which are provided. EACH ITEM TAKEN FROM THE UNIT WILL RESULT IN A CHARGE UP TO $20 EACH TO YOUR CREDIT CARD OR AGAINST THE DEPOSIT. Since SMRV provides the normal amount of toilet paper and paper towels for FAITH, it may be necessary that the RENTER bring additional items for personal use during the reservation.

10. RENTERS LIABILITY: RENTER agrees to accept liability for any damage(s) caused to the camper by RENTER or RENTERS’ guests, including, but not limited to, damage to FAITH in any way or damage to any appliances and/or equipment furnished. If damages are more than the security deposit being held, RENTER agrees to reimburse SMRV for costs incurred to repair/replace damaged items.

11. HOLD HARMLESS: SMRV does not assume any liability for loss, damage, or injury to persons and/or their personal property. Neither does SMRV accept liability for any inconvenience arising from any temporary defects or stoppage in the supply of water, gas, electricity, or plumbing. SMRV does not accept liability for any loss or damage caused by weather conditions, natural disasters, or other reasons beyond SMRV’s control.

12. AWNING: Due to the weather changing in a matter of seconds, the awning can be used at the RENTER’s risk. The RENTER is liable for any and all damages caused to and by the awning. An additional deposit may be required for using the awning.

13. ADDITIONAL TERMS AND CONDITIONS: The undersigned, for himself/herself, his/her heirs, assignors, executors, and administrators, fully releases and discharges SMRV, from any and all claims, demands and causes of action by reason of any injury or whatever nature which has or have occurred, or may occur to the undersigned, or any of his/her guests as a result of, or in connection with the occupancy of the premises and agrees to hold SMRV free and harmless of any claim or suit arising therein. In any action concerning the rights, duties, or liabilities of the parties to this agreement, their principals, agents, successors, or assignees of the prevailing party shall be entitled to recover reasonable attorney fees and costs. If the RENTER violates any conditions of this agreement, SMRV may terminate this agreement and enter the premises and the camper. Upon notice of termination of this agreement, RENTER shall vacate the camper immediately. In the event SMRV must resort to legal process to enforce rights under this Agreement, RENTER shall be responsible for reasonable Attorney fees and costs. RENTER agrees this contract is entered into in Greene County, Missouri, and consents to the personal jurisdiction of any proper court located therein.
